Florida Consumer Collection Practices Act (“"FCCPA”)
The FCCPA is a Florida law designed to protect consumers from abusive and harassing behaviors from creditors and debt collectors. A consumer is not just the original consumer who incurred the debt but also refers to the debtor’s spouse, parent, or guardian. Most kinds of debts are protected from illegal debt collection practices, including obligations for personal, family, or household purposes such as credit card debts and hospital bills.
As a result, consumers can have a cause of action against either a creditor or debt collector if the companies violate a list of restrictions designed to protect the consumers’ right to privacy and peace of mind.
Fair Debt Collection Practices Act (“FDCPA”)
Similar to the FCCPA, the FDCPA is an older, yet very important federal law which is designed and utilized to protect consumers from abusive and harassing actions by debt collectors.
Although a handful of debt collection agencies attempt to abide by the rules, many fail to respect the privacy of the consumers they are after. Many fail to contact the right consumer, harassing a victim unnecessarily by calling several times a day at inconvenient hours.
Failure to follow the FDCPA can open these debt collectors to liability and allow consumers to sue these debt collectors and make sure that they stop harassing them and their loved ones.
Fair Credit Reporting Act (“FCRA”)
The Fair Credit Reporting Act or FCRA is a federal law that regulates the collection of consumer credit information and access to credit reports. This federal law governs the collecting and reporting of consumer credit information. This includes how the credit bureaus may obtain the information, how long they may keep it, and how they can share it with other entities.
In short, the FCRA is instrumental in the following:
Regulation of credit bureaus’ actions
Regulation of information businesses receive about individual consumers
Providing rights to consumers to allow them avenues to correct any inaccurate or incorrect information
Additionally, the FCRA places restrictions on who can view your credit report and when. Typically, the consumer initiates a transaction that gives consent to have their report evaluated by the entity they wish to borrow money from.

Jennifer Simil is sole proprietor of The Law Office of Jennifer Simil, PLLC. She graduated from Florida International University College of Law in 2019 and has been practicing law ever since.
Jennifer has previously represented homeowners in First Party Property lawsuits when insurance companies refused to provide coverage for damages to homes as a result of Hurricanes Irma and Michael, along with fires and flooding as a result of burst pipes. She briefly worked as a defense attorney for the insurance companies, gaining insight into their processes when it came to coverage decisions. She quickly decided that she was more interested in representing normal people against massive companies.
Jennifer then became a Consumer Protection Attorney, suing companies for violations of the Florida Consumer Collection Practices Act (“FCCPA”), the Fair Debt Collection Practices Act (“FDCPA”), and the Fair Credit Reporting Act (“FCRA”). These violations ranged from suing companies for sending emails to consumers trying to collect debts between the hours of 9PM and 8AM, suing debt collectors for harassing phone calls and emails, and suing the Credit Reporting Agencies (Equifax, Experian, and TransUnion) for reporting inaccurate information from Creditors and Debt Collectors despite disputes by Consumers informing them of the inaccurate information.
